Voting Question: Can uncle get some jail time for this charge? help?

Ok so i'm 17 and my uncle (46) and cousin were getting Luann for floor. My mom called and she needed me to talk about something, after i hung up the phone, he said that i needed to get off the phone...there was no one important no one died etc so i go out of the door i go down the steps saying i'm coming christ! about 5 secs i get a text i reply and he says well you need to get to work you lazy piece of sh*t. I say F*** you he then approaches me saying what did you say what di dyou say and puts his hands around my throat. then lies to the cops (i call them shortly after he lets me go) saying he's intimidated of me. can he get a jail sentence?
